License Grant
License: Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, and revocable license to use our software for your personal or internal business purposes.
Restrictions: You may not: Use the software in any unlawful manner or for any unlawful purpose. Modify, adapt, translate, or create derivative works of the software. Reverse engineer, decompile, disassemble, or attempt to extract the source code of the software. Sell, sublicense, transfer, or distribute the software to any third party.
Indemnification
Limitation of Liability: By using software, services, source code provided by Gameplay Intelligence Framework you agree to indemnify, defend, and hold harmless Gameplay Intelligence Framework and its affiliates, officers, directors, employees, agents, and licensors from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) that arise directly or indirectly from:
- Your violation of any third-party right, including without limitation any intellectual property or privacy right.
- Your use of the Software,
- Your violation of any provision of these Terms,
Exclusion of Damages: In no event shall we be liable to you or any third party for any indirect, consequential, incidental, special, punitive, or exemplary damages, arising out of or in connection with your use of our software, whether based on warranty, contract, tort (including negligence), or any other legal theory.
Disclaimer of Warranties
Use at Your Own Risk: Our software is provided on an “as-is” and “as available” basis. We disclaim all warranties, whether express, implied, or statutory, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
No Guarantee: We do not guarantee that our software will be uninterrupted or error-free, or that defects will be corrected. We make no representations or warranties about the accuracy, reliability, completeness, or timeliness of the software or any content therein.
Generated Output: Outputs may included but are not limited to images, generated text, generated instructions, positional data and in-game co-ordinates. You and your users are solely responsible for Outputs and their subsequent uses. We are not responsible for actions, direct or indirect, that result from use of the software.
Third Party Software
Limitation of Liability : Any and all third party software provided by Gameplay Intelligence Framework or included in any software provided by Gameplay Intelligence Framework is provided “as is” and “as available” basis and is subject to the terms of use and privacy policies of that software. Gameplay Intelligence Framework is not responsible for any loss or damage caused from the use or misuse of third party software.
Redistribution : Third party software is distributed by Gameplay Intelligence Framework in accordance with that vendors licensing terms. All artwork, logos and branding are used in accordance with the associated license and branding guidelines.
Google Gemma
Use Restrictions: You must not use any of the Gemma Services:
- for the restricted uses set forth in the Gemma Prohibited Use Policy at ai.google.dev/gemma/prohibited_use_policy (“Prohibited Use Policy“), which is hereby incorporated by reference into this Agreement; or
- in violation of applicable laws and regulations.
To the maximum extent permitted by law, Google reserves the right to restrict (remotely or otherwise) usage of any of the Gemma Services that Google reasonably believes are in violation of this Agreement. Full Google Gemma terms of use can be found here.
